1. Overview This website is operated by Paxton Initiative Pty Ltd (ABN 48 690 969 790), trading as Why Be Better ("we", "us", "our"). By accessing or using whybebetter.com.au or placing an order, you agree to these Terms of Service and all policies referenced here, including our Shipping Policy, Returns & Refund Policy, and Privacy Policy. If you do not agree, please do not use the site.

2. Eligibility By using this site you confirm you are at least 18 years of age, or are accessing the site with the involvement and consent of a parent or guardian.

3. Products, pricing & availability All prices are listed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change prices, descriptions, and product availability at any time without notice. We make every effort to display products and colours accurately, but cannot guarantee your screen accurately reflects the actual item. All products are subject to availability and we may limit quantities or discontinue any product at any time.

4. Orders By placing an order you make an offer to purchase. We reserve the right to accept or decline any order at our discretion, including where an item is out of stock, where there has been a pricing or description error, or where we suspect fraudulent or unauthorised activity. If we cancel an order after payment, you will receive a full refund for that order.

5. Pricing & listing errors In the event a product is listed at an incorrect price or with incorrect information due to a typographical, system, or other error, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed and payment processed. If this occurs, we will refund you in full.

6. Payment Payment must be received in full before an order is dispatched. We accept the payment methods displayed at checkout. You confirm that you are authorised to use the payment method provided and that the details you supply are true and accurate.

7. Shipping & delivery Shipping and delivery are governed by our Shipping Policy. Delivery timeframes are estimates only and are not guaranteed.

8. Returns & refunds Returns and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.

9. Consumer guarantees Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you are entitled to under the Australian Consumer Law or any other applicable law that cannot be lawfully excluded.

10. Limitation of liability To the maximum extent permitted by law, and other than for liability that cannot be excluded under the Australian Consumer Law, we are not liable for any indirect, incidental, or consequential loss arising from your use of this site or from any product purchased. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price paid.

Intellectual property All content on this site — including logos, branding, designs, graphics, product imagery, text, and the "Why Be Better" name and marks — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, republish, distribute, or use any of our content or branding without our prior written permission.

12. Acceptable use You agree not to use this site for any unlawful purpose, to interfere with its operation or security, to attempt unauthorised access to any part of the site, or to use it in any way that could damage, disable, or impair the service.

14. Changes to these Terms We may update or amend these Terms at any time. The version published on this site at the time you place an order applies to that order. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

15. Governing law These Terms are governed by the laws of the State of Queensland and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
